Refund Policy

This Refund Policy explains when and how you can obtain a reprint, replacement, or refund for items purchased at apexrev.store. It applies in addition to your statutory rights under EU consumer law, including Directive 2011/83/EU (Consumer Rights) and Directive (EU) 2019/771 (Sale of Goods).

1. The Print-on-Demand Model — What This Means for Returns

Each Apex Rev item is manufactured only after you place an order, by our fulfilment partner Gelato APS and its production network. Even though items are produced after purchase, our standard catalogue (any tee, hoodie, crewneck, cap, long sleeve, or tote in standard sizes and standard colours) is made from a fixed, pre-defined assortment that any customer can order without modification. Under the case law of the Court of Justice of the European Union (notably Case C-681/17, slewo / Sascha Ledowski), such items are not "made to the consumer's specifications or clearly personalised" within the meaning of Article 16(c) of Directive 2011/83/EU.

Accordingly:

  • EU/EEA consumers buying standard-catalogue items have the full 14-day right of withdrawal under Article 9 of Directive 2011/83/EU. You may withdraw from the contract within 14 days of receiving the goods, without giving a reason, and receive a refund of the price plus standard outbound shipping. The procedure is described in our Terms of Service, Section 6.
  • Custom orders — items produced to a customer-specific brief, custom prints, bespoke designs, or one-off personalisations — are excluded from the 14-day withdrawal right under Article 16(c) of Directive 2011/83/EU. Apex Rev does not currently offer custom orders; this clause is reserved for future custom-order capability and will be enforced only when explicitly flagged at checkout.
  • Defective, damaged, or wrong-item claims are always honoured under the EU Sale of Goods Directive (2019/771), regardless of any restriction on the standard withdrawal right. These claims are handled separately from the 14-day withdrawal procedure (see Section 2 below).

2. When You Are Entitled to a Reprint or Refund (Non-Conformity)

Independently of the 14-day withdrawal right, you may request a free reprint or a refund (your choice, where reprint is impractical) if any of the following applies:

  1. Manufacturing defect — for example, faulty stitching, holes, fabric defects, ink smudges, peeling print, or visible misalignment beyond reasonable tolerance.
  2. Wrong item received — wrong design, wrong size, wrong colour, or wrong product compared with the order confirmation.
  3. Damage in transit — the parcel arrives visibly damaged and the product inside is affected.
  4. Print quality issue — colours significantly different from the design proof, blurry print, or off-centre placement beyond Gelato's standard tolerance.

Minor variations inherent to print-on-demand manufacturing — such as small differences in placement (typically up to 1 cm), slight colour shift between batches, or texture variation across fabric lots — are not considered defects.

3. How to File a Claim

To start a claim, contact support@apexrev.store within 30 days of receiving the parcel and include:

  • Your order number.
  • A clear description of the issue.
  • Photos:
  • For defects: close-up of the affected area in good light.
  • For wrong items: a photo of the product alongside the shipping label.
  • For transit damage: photos of both the outer packaging and the product.
  • For sizing issues caused by manufacturing error (e.g. mislabelled size): a photo of the size tag and a measurement reference.

We typically acknowledge claims within 2 business days and resolve them within 10 business days of receiving complete information.

4. Outcome of an Approved Claim

Where a claim is approved we offer, depending on the case:

  • A free reprint shipped to the same address (default option for production defects).
  • A full refund to the original payment method, including outbound shipping costs, if reprint is not feasible or you prefer it under your statutory rights.
  • A partial refund by mutual agreement, where the issue is minor and you wish to keep the item.

Refunds are processed within 14 days of approval and may take a few additional business days to appear on your statement, depending on your payment provider.

You are not generally required to return the defective item — Gelato's quality process usually only needs the photo evidence. If a return is necessary, we will provide a prepaid label or instructions; you will not bear the return cost in approved-defect cases.

5. Sizing — Read Before You Buy

Incorrect size choice by the customer is not a manufacturing defect and does not give rise to a non-conformity claim under Section 2. However, EU/EEA consumers who buy standard-catalogue items retain the full 14-day right of withdrawal (Section 1 above) and may use it for any reason, including a sizing mistake — subject to the return-shipping rules described in our Terms of Service, Section 6. We strongly recommend:

  • Reviewing the size guide on each product page before purchasing.
  • Comparing measurements with a similar item you already own.
  • Contacting us at support@apexrev.store before checkout if you are unsure — we are happy to help.

6. Order Cancellation Before Production

If you contact us before the item enters production at Gelato (typically within a few hours of order confirmation), we will cancel the order and issue a full refund. Once production has started — which can be very fast — cancellation under this section is no longer possible, but the 14-day right of withdrawal described in Section 1 remains available for standard-catalogue items after delivery.

7. Lost Parcels

If tracking shows that your parcel has not moved for an extended period or has been declared lost by the carrier, contact us. We open an investigation with the carrier; once the loss is confirmed, we ship a replacement at no cost or, at your option, refund the order. See our Shipping Policy for typical timelines.

8. Refused or Undelivered Parcels

If a parcel is returned to the production facility because the address was incorrect, the recipient was unavailable for repeated attempts, or the parcel was refused at delivery, we may:

  • Reship at your cost, after confirming the corrected address; or
  • Refund the price of the goods, excluding the original shipping cost, once the parcel has been received back by the production facility.

9. Statutory Rights

Nothing in this Refund Policy limits or replaces your non-waivable rights as a consumer in the EU/EEA, the United Kingdom, or any other applicable jurisdiction. You may always rely on your statutory remedies for non-conformity of goods and on the 14-day right of withdrawal where it applies.
